Preamble
These Terms and Conditions of Sale (hereinafter the "T&Cs") apply to all sales of digital photograph files (hereinafter the "Photos") concluded via the website www.youinthespot.com (hereinafter the "Site") between:
The Sole Proprietorship Renaud COLLET, operating under the trade name youinthespot, registered in the SIRENE directory under SIRET number 483 682 399 00033, identified by intra-Community VAT number FR56483682399, whose registered office is located at 28 rue Béranger, 93310 Le Pré-Saint-Gervais, France, and whose contact e-mail address is contact@youinthespot.com (hereinafter the "Author" or the "Seller").
And:
Any natural person of legal age acting as a consumer (private individual) who purchases a Photo on the Site (hereinafter the "Customer").
Article 1 – Purpose
The purpose of these T&Cs is to define the rights and obligations of the parties in connection with the online sale of high-definition digital photographs offered by the Author on the Site. The purchase of a Photo entails the Customer's unreserved and unconditional acceptance of these T&Cs, expressed by a mandatory checkbox before any payment.
Article 2 – Characteristics of the goods sold
The Photos offered for sale are intangible digital files (generally in JPEG format) in high definition. The characteristics of each Photo (raw resolution, indicative dimensions, subject) are presented on the Site. The Customer is informed that minor variations in colour or contrast may appear depending on the calibration and nature of the screen used to view the Photo, which shall not engage the Author's liability.
Article 3 – Prices and VAT
The prices of the Photos are indicated on the Site in Euros (€).
As the Seller's Sole Proprietorship is subject to VAT, prices are displayed inclusive of all taxes (VAT included) at the statutory rate in force in France (20% for the sale of digital files to private individuals).
The Author reserves the right to modify prices at any time, but the Photos will be invoiced on the basis of the rates in force at the time the order is validated.
Article 4 – Order and payment terms
Placing an order: The Customer selects the Photo(s) of their choice, adds them to their cart, enters their e-mail address and validates their cart.
Acceptance of the T&Cs: The Customer must mandatorily tick the box accepting these T&Cs in order to proceed to the payment stage.
Payment: Payment is due immediately upon ordering. It is made securely by bank card via the payment provider Stripe. The Customer's bank details are encrypted and never pass through the Author's IT system.
Confirmation: The sale is considered final once payment has been validated by Stripe. A confirmation e-mail summarising the purchase is automatically sent to the Customer, together with a compliant invoice showing the pre-tax amount, VAT at the rate of 20% and the total amount inclusive of tax.
Article 5 – Delivery of digital files
Delivery is made exclusively by electronic means. Immediately after payment is validated, an e-mail containing a unique and secure download link is sent to the e-mail address provided by the Customer.
Unless otherwise stated on the Site, this download link remains active for a period of 30 days from the date of purchase. It is the Customer's responsibility to record and save the file on their own computer storage.
Article 6 – No right of withdrawal (crucial)
In accordance with the provisions of Article L.221-28 13° of the French Consumer Code, the 14-day right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium whose performance has begun after the consumer's express prior consent and express waiver of their right of withdrawal.
By ticking, when ordering, the dedicated box provided for this purpose (separate from the acceptance of these T&Cs), the Customer expressly requests the immediate performance of the service before the end of the withdrawal period and expressly waives their right of withdrawal. No refund, return or exchange will be accepted once the download link has been made available.
Article 7 – Intellectual property and restriction on commercial use
All photographs present on the Site and sold through it remain the exclusive intellectual property of the Author, holder of the copyright within the meaning of the Intellectual Property Code.
Authorised use (private context): The purchase of a Photo grants the Customer a licence of use strictly limited to personal, private and non-commercial use. The Customer is authorised to store the Photo on their devices, to share it on their personal social networks (without modification or removal of the Author's credit if present), or to make physical prints (paper prints, framed prints) exclusively intended for their private decoration or for a non-remunerated gift.
Prohibited uses (commercial and professional context): Any commercial, advertising or professional use is strictly prohibited without the Author's prior written consent. The following are notably prohibited: the resale of the file, the use of the Photo by a brand, a company, an association, an athlete's sponsor, a media outlet or a magazine (print or web), as well as the incorporation of the Photo into image banks or the creation of commercial derivative products.
Any unauthorised commercial exploitation will be subject to legal proceedings and to immediate invoicing of copyright fees at the professional rate in force.
Article 8 – Liability
The Author undertakes to provide digital files free from defects and usable. However, the Author's liability cannot be engaged in the event of a malfunction of the Internet network, a temporary interruption of the Site, incorrect entry of the e-mail address by the Customer, or technical incompatibility of the file with the Customer's reading software. The Author's liability is, in any event, limited to the amount of the Photo purchased.
Article 9 – Personal data
The Author collects the personal data strictly necessary for processing the order and sending the files (at minimum the e-mail address; where applicable, the billing information provided by the Customer). This data is processed in accordance with the GDPR regulation, is never resold to third parties and is shared only with the provider Stripe for the strict needs of payment. The Customer has a right of access, rectification and deletion of their data by contacting the Author by e-mail. The detailed procedures are set out in the Privacy Policy.
Article 10 – Consumer mediation
In accordance with Articles L.612-1 et seq. of the Consumer Code, the consumer Customer has the right to use, free of charge, a consumer mediator with a view to the amicable resolution of a dispute with the Author, provided that they have first sent a written complaint to the latter.

Article 11 – Applicable law and disputes
These T&Cs are subject to French law. In the event of any dispute or litigation relating to the interpretation or performance of these terms, the parties undertake to seek an amicable solution before any legal action. Failing an agreement, the dispute will be brought before the competent French courts.
